The Environmental Permitting Regulations (EPR) (which supersede the PPC Regulations) require installations to be operated in such a way that “all the appropriate preventative measures are taken against pollution, in particular through the application of Best Available Techniques (BAT). The definition of pollution includes “emissions which may be harmful to human health or the quality of the environment, cause offence to any human senses or impair or interfere with amenities and other legitimate uses of the environment”. In terms of noise, the imperative should be to ensure that the installation does not give rise to reasonable cause for annoyance.

To demonstrate that the requirements of the EPR will be met, it is often necessary to carry out an assessment of the noise emissions associated with a scheme, demonstrating that no reasonable cause for annoyance will arise from operation and that, where necessary, BAT are being employed in the control of noise.

  • EPR permit and planning applications;

  • Compliance monitoring; and
  • Appeals.
